1. Overview

Apollo Group TV Premium ("Apollo Group TV," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. 4. Counter-Notification Procedure

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include the following information:

4.1 Required Information for Counter-Notice

  1. Your contact information: Your name, address, phone number, and email address.
  2. Identification of the material: Description of the material that has been removed or to which access has been disabled, and the location where the material appeared before removal or disabling.
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Physical or electronic signature: Your physical or electronic signature.

⚠️ Legal Consequences

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability. Please consult with legal counsel before filing a counter-notification.

4.2 Counter-Notification Process

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. If we do not receive notice within 10-14 business days that the original complainant has filed a court action to prevent further infringement, we may restore the removed material or cease disabling access to it.

5. Policy on Repeat Infringers

In accordance with the DMCA and other applicable laws, Apollo Group TV Premium has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts or access of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. False Claims and Misrepresentation

The DMCA provides that any person who knowingly materially misrepresents:

  • That material is infringing, or
  • That material was removed or disabled by mistake or misidentification

shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner or its authorized licensee, or by the service provider, who is injured by such misrepresentation as a result of our relying upon such misrepresentation in removing or disabling access to the material claimed to be infringing.

We take false claims very seriously. Before submitting a DMCA notification or counter-notification, please ensure that all information provided is accurate and that you have the legal authority to make such claims.

8. Modifications to This Policy

Apollo Group TV Premium reserves the right to modify this DMCA Policy at any time. We will notify users of any material changes by posting the new policy on this page and updating the "Effective Date" at the top of this document. Your continued use of our services after any such changes constitutes your acceptance of the new policy.
